Changes to the social security coordination regulations. Posting of workers. The European and Polish case-law.

The EC-funded MoveS network (Free Movement and Social Security Coordination) organised an online seminar on 16 November 2022.

The seminar was organised by MoveS in collaboration with its Polish national expert, Gertruda Uścińska. MoveS is an EC-funded network of independent experts from 32 European countries coordinated by Eftheia and Deloitte.

The seminar focused on the consequences of the changes in the EU Regulation No. 883/2004 and the new amendments to the Posting Directives (EU) 2018/957 and 2014/67, in particular the credibility of the A1 documents in Europe, including the prevention of forgery and the determination of applicable legislation. Marginal work and marginality criteria in the context of employment and self-employment were also discussed, including good practices in cooperation with the competent institutions of other EU Member States in detecting fraud situations.

Recent relevant case-law in the area of free movement of workers (FMW) and social security coordination (SSC) with reference to the Court of Justice of the European Union (CJEU), Polish administrative courts and Polish labour and social insurance courts, in the years 2010-2020 were   presented with the aim to determine the key directions and tendencies in the recent case-law in the area of SSC and FMW.
